A - General organisation and management

1. The Marsden Village Directory is an online directory including details of local bricks-and-mortar businesses, groups and activities, community hubs, annual events, regeneration projects and useful visitor information in the village of Marsden, West Yorkshire. The information within each profile has been contributed by its owner or found in publicly available sources e.g. via Google.

2. The Marsden Village Directory is managed by Hannah Gill, Project Lead, with the support of the other directors of the Marsden Village Website Project Community Interest Company (abbreviated to ‘the CIC’ hereafter). All of this is done on a volunteer basis. Website designers ‘Not Another Social’ have also been providing paid technical support in the building of the website, but will primarily continue in a volunteer role going forward.

3. The majority of the Directory profiles are free; a small number are paid to cover the costs of the site. From here on, any reference in this document to ‘profile’ or ‘the profiles’ includes both free and paid profiles.

4. Only bricks-and-mortar businesses that are customer-facing and form the fabric of the village are allowed to have a free profile in the main body of the site. Sole traders and similar who do not fit that brief are welcome to take a paid profile subject to qualifying and availability (see Section C). Hereafter ‘paid profile’ and ‘advert, advertiser, advertising slots etc.’ will be used interchangeably.

B - Information contained in the Directory

1. The directors of the CIC and website designers ‘Not Another Social’ are simply presenting the information contained within the Marsden Village Directory website. They are not in any way individually or collectively promoting or recommending any of the above to any member of the public, whether resident or a visitor to the village.

2. Neither the directors of the CIC or website designers ‘Not Another Social’ can guarantee the accuracy of any information included in the Marsden Village Directory website and they do not verify third-party content.

3. Any person who takes any action resulting from their engagement with the information on the Marsden Village Directory website, for example (but not exclusively) anyone who visits, buys from or hires any business featured in the profiles…participates in any of the various activities featured in the profiles…visits, uses or hires any of the facilities featured in the profiles…or buys tickets for an event or attends any event featured in the profiles…therefore does so at their own risk.

4. Neither the directors of the CIC or website designers ‘Not Another Social’ are responsible or liable (to the fullest extent permitted by law) for any inconvenience, injury or loss of any kind resulting from such engagement, participation or attendance.

5. All users of the site are advised to read any profile in full before deciding to take any action in response to it. Any advisory badges that have been placed on it regarding wheelchair access information, activities for young people or opportunities to volunteer are for general guidance only and site users are advised to contact the profile owner directly for more information.

6. The presence of the ‘Y’ badge (indicating activities for young people) on any profile is not an indication that young people can undertake that activity without their parents/guardians/carers there with them. It has been applied simply to illustrate that an activity may appeal to young people and to promote activities for young people within the community.

7. Neither the directors of the CIC or website designers ‘Not Another Social’ take any responsibility for the inclusion of any persons in any of the pictures chosen by profile holders. All profile holders have been requested to secure all necessary permissions before sending any photographs for use in the Marsden Village Directory website. Any other photos taken or selected by the directors of the Marsden Village Directory website have been doctored so the identity of any persons included is concealed.

8. All content included on this website, including but not limited to photographs, text, graphics, logos and images, is the property of Marsden Village Website Project CIC or its content suppliers (the profile holders themselves) and is protected by international copyright laws.

9. You may not copy, reproduce, publish, transmit, distribute, modify, or commercially exploit any of the photographs on this website without obtaining explicit written permission from Marsden Village Website Project CIC (who will forward that request to any relevant party). C - Profile holders on the Directory

1. Neither the directors of the Marsden Village Website Project CIC or website designers ‘Not Another Social’ are responsible or liable (to the fullest extent permitted by law) for any complaint, negative action or reputational damage experienced by the owner of any Marsden Village Directory website profile.

2. Neither the directors of the CIC or website designers ‘Not Another Social’ are responsible for the website going offline for any length of time since the site is hosted by Squarespace. That means any hosting issues are for Squarespace to resolve and out of the control of the website designers ‘Not Another Social’ or the directors of the CIC.

3. To qualify for a paid profile a sole trader or similar must be Marsden-based and have some kind of meaningful online presence e.g. a business Facebook page or business website.

4. Advertising slots will be allocated on a first come, first served basis.

5. Any advertiser’s presence in the Directory via a paid profile does not in any way imply endorsement on behalf of the directors of the CIC or website designers ‘Not Another Social’.

6. Any profile owner who holds a paid profile will pay in advance for whatever period has been agreed on. The full annual rate for that particular year will be clearly stated on said invoice.

7. When the inaugural 3 month advertising period is over, any current paid profile owner will, at the CIC’s discretion, have a week’s first refusal related to whether they’d like to continue the advert for the following year. In future years advertising will be sold on a year by year basis.

8. Payment for paid profiles on the Marsden Village Directory website is for listing space, not outcomes or results.

9. No refunds will be available should the holder of any paid profile decide that they no longer want to retain the space for the advertising term they’ve paid for.

10. Should any advertiser do anything that brings the Marsden Village Directory website into disrepute, their advert will be cancelled without any refund given.
